After falling from Roe v. calf, some conservatives seem ok with “sending abortion back to the states,” but only if that means leaving the decision to state legislatures rather than actual voters in those states. governor of West Virginia, party switcherand Bulldog Humiliator Jim Justice (R) said Monday he opposes a proposal by Democratic lawmakers to put access to abortion on the ballot in a referendum. according to to the associated press. And of course he does considering what happened when Kansas did.

The stateroe abortion will be banned clogged by a judge, and Republicans failed to pass legislation criminalizing abortion in a special session this summer. Democrats asked the judiciary on Friday to hold another special session so they could consider a resolution to amend the constitution (read: a voting measure that would lead to a popular vote) for “reproductive freedom.” The AP said Justice “mockedUnder the idea and said state abortion law, only the legislature and the attorney general have jurisdiction. No democracy allowed.

“Unfortunately, there’s a constant swagger surrounding this place,” Justice said said at a press conference on Monday. “I think that’s what the Democrats do.”

I think what Republicans like Justice do is the how Voters defeated in Kansas an anti-abortion amendment by almost 20 points – with the pro-choice position surpass Donald Trump’s results for 2020 – and very, very nervous. I think what Justice is doing is reading the poll coverage that shows that a majority of Americans want to vote directly on abortion and would vote to protect access.

As my colleague Caitlin Cruz wrote last week:

In a new poll published Wednesday by USA Today/Ipsosseven out of ten Americans – 70 percent! — said they want to vote on abortion like what just happened Kansas. If a voting measure were introduced, more than half said they would vote to legalize abortion. When that number is broken down by party affiliation, 76 percent of Democrats would vote for abortion, as would 52 percent of independent voters and 34 percent of Republicans.

When a Republican claims that abortion should be a state issue, not a federal one, but then wants to limit who can get involved in the state, that’s a huge, hypocritical red flag.
