Under this oath, the only proper outcome on this matter is to dismiss the charges against Ms. Herrera immediately,” Ramirez said in a statement.

To ignore this fact would be short-sighted,” he wrote. “The issues surrounding this matter are clearly debatable, but based on Texas law and the facts presented, it is not a criminal matter.”

The notice of termination will be filled out on Monday morning

“I hope that the dismissal of this case will clarify that Ms. Herrera did not commit a crime under the laws of the State of Texas,” Ramirez said.
