Maira Gutierrez killed: ex-boyfriend Daniel Chacon arrested in Mexico, main interest in Pasadena woman murder

PASADENA, TX (KTRK) — The ex-boyfriend of a Pasadena woman found shot to death in her vehicle earlier this week is being held in custody in Pasadena. He was arrested in Mexico on Wednesday evening, police said.

Daniel Chacon, 30, is accused of kidnapping 38-year-old Maira Gutierrez at gunpoint but is also believed to be the main person interested in her murder.

Chacon was arrested around 11:30 p.m. in Nuevo Laredo, Tamaulipas, Mexico — just across the border from Laredo, Texas — Pasadena police said.

Witnesses from court documents saw him threaten Gutierrez with a gun Monday morning at the Red Pines apartment complex in Pasadena before forcing her to go with him. She had gone there to visit her child. That evening her body was found in her silver SUV in southeast Houston.

The documents say that Chacon walked up to his uncle’s house that day, where he apologized and said he had screwed up. This is the same uncle who called the Pasadena Police Department to report that Chacon also told him the day before she was killed, “I think I’m going to have to kill this girl.”

Pasadena police officers assigned to the Gulf Coast Violent Offenders Task Force, the US Marshall Service, the DEA, and Customs and Border Patrol agents cooperated in the arrest of the wanted man.

“Our officers and federal agencies worked tirelessly all night negotiating directly with him for a safe surrender at the Laredo Port of Entry,” the Pasadena Police Department said in a statement.

Pasadena officers were en route to Webb County to take Chacon into custody and return him to the Houston area.

Records show that Chacon’s criminal history of violence against women in Harris County dates back to 2012. He has been convicted twice in the past of common law assault on his ex-wife and once of violating a protection order.

He shares three children with his former partner. Her family said they would not speak out publicly to protect her.

Chacon also shares a 5-month-old daughter with Gutierrez.

Pasadena police said Gutierrez and Chacon had a two-year relationship. Both had been involved in two previous domestic violence cases with the department.

On September 1, Chacon called the Pasadena police department to report that Gutierrez was driving a vehicle with her drunk child. It was later determined that she wasn’t, according to Pasadena Police Chief Josh Bruegger.

During an investigation into the case, Gutierrez raised allegations of a gun attack that took place a few days earlier. Officers searched the home but did not find a gun. Bruegger added that Gutierrez did not want to press charges, but officers contacted the Harris County Attorney’s Office about possible charges, which were dismissed at the time.

Authorities believe Gutierrez moved out of the apartment she shared with Chacon between the first and second incidents.

On September 14, Gutierrez went to Chacon’s home to visit her 5-month-old daughter. She reported that Chacon grabbed her by the hair and dragged her through the apartment. She added that he had attacked her several times in the past.

Several hours after this incident, Gutierrez called the Pasadena police. Officers arrived, took all their information and tried to locate the suspect but were unsuccessful. Officers again approached prosecutors with the charges, but they were denied and referred to family violence investigators.

“We took it very (seriously) from the start,” said Bruegger. “We must rely on the cooperation of victims throughout the process and decisions will be made based on evidence.”

So far, Chacon has only been charged with aggravated kidnapping, but police said the charges against him could be increased as the investigation progresses.
