Alec Baldwin ‘trying to clear his name’ in new lawsuit against ‘Rust’ gunsmith, crew

Alec Baldwin is taking an unprecedented legal step to continue Rust’s deadly on-set filming that resulted in the death of cinematographer Halyna Hutchins.

In court filings obtained from individuals, the Foundation Scholarship Selectee, 64, attempted to “demonstrate his innocence” after practicing with the prop gun when it failed, killing Hutchins and assaulting writer director Joel Souza on October 21, 2021 in St Nick Fe, NM “More than any other person on the set, Baldwin was wrongly blamed for this tragedy,” the statement reads.

The cross-protest, recorded Friday in Los Angeles-area Superior Court, names a subset of similar people blamed for negligence in screenwriter Mamie Mitchell’s 2021 lawsuit, which also recently picked up Baldwin, the founding organization and others became.

Should Mitchell triumph in her lawsuit, Baldwin is seeking some of those damages for himself, his court filings show.

The entertainer, who stars and creates in the western, takes on armorer Hannah Gutierrez Reed, collaborator boss David Lobbies, props ace Sarah Zachry and assistant armorer Seth Kenney in Cross-Objection, as well as Kenney’s prop gun and ammo storage organization. Baldwin’s attorneys, Luke Nikas and Robert M. Schwartz, noted that the litigants “owed those on set, including Baldwin, an obligation to keep the set safe. Everyone on set, including Baldwin, expected and trusted that they would.”

The claim reads: “This accident occurred on a film set – not a gun compound, not a war zone, not a place where there should be even a small chance that a firearm would contain live ammunition.

It was done under the supervision of an experienced armorer, Gutierrez-Reed, and the Primary Right Hand Chief, Lobbies, who were recruited to protect the entertainers and crew on set.

“This mishap happened on the grounds that live shots were carried to the set and stacked in the gun, Gutierrez-Reed failed to carefully inspect the slugs or the firearm, Corridors failed to inspect the gun carefully, but explained that the gun protected from giving it was Baldwin, and Zachry failed to reveal that Gutierrez-Reed had misbehaved on set and posed a danger to everyone around her,” the allegations said. Baldwin’s nagging jury finding of “compensatory, alleged, legal and corrective damages” tentative.

St. Nick Fe Provincial Chief Prosecutor Mary Carmack-Altwie said in September that Baldwin faces criminal penalties in the fatal shooting.

Also, he and the film’s creators have been faced with a number of lawsuits, including one recorded by Hutchins’ family for wrongful death that was settled a month ago.
